Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Detention

A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.

The situation stems from a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his repatriation to the United States to face human smuggling charges, he was detained in federal detention.

In her decision, the judge pointed out that the authorities does not have a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "at this time."

Background of the Legal Challenge

The legal challenge center on conflicting claims. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this claim.

He has also pleaded not guilty to the conspiracy charges, which are part of a separate criminal case in Tennessee.

The judge, who was hearing his challenge to removal in a Maryland district court, determined that he must now adhere to the conditions of his release from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
